SINGH ORAL ORDER 02-12-2024 Heard learned counsel for the petitioners and learned A.P.P appearing on behalf of the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Section 498(A) of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

The accusations are of demand of dowry, torture and making an attempt to kill the daughter of the informant.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.79250 of 2024(2) dt.02-12-2024 2/3 petitioners that petitioners are innocent and they have falsely been implicated in this case. The petitioners are father-in-law and mother-in-law of the daughter of the informant and they have no concern with the day-do-day affairs of the daughter of the informant and her husband. The police after investigation submitted final form against the petitioners and did not sent them for trial but the learned A.C.J.M, differing with the view of the I.O took cognizance against the petitioners for the said offence. The daughter of the informant had earlier filed Complaint Case No. 72 of 2020 wherein the petitioners and other family members were granted bail. The son of the petitioners had lodged a Sanha on 23.01.2024 and thereafter on the very next day, the present F.I.R has been lodged on 24.01.2024. The petitioners' side has also filed Divorce Case No. 86 of 2024 for dissolution of marriage.

Considering the fact that petitioners are parentsin-law of the victim and the facts as discussed above, let

No.79250 of 2024(2) dt.02-12-2024 3/3 the petitioners, above named, in the event of their arrest or surrender before learned Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 18 of 2024.
