Petitioner, already in custody, seeks bail in connection with Araria P.S. Case No.769 of 2017, registered under Sections 363 and 366A/34 of the Indian Penal Code.

Allegation in brief is that the petitioner enticed away the minor daughter of the informant.

Learned counsel for the petitioner submits that the girl in her statement admits her elopement with the petitioner and in the FIR the mother has stated her age 16 years. Learned APP appearing on behalf of the State submits that the girl is minor only 14 years of age disclosed by her and impugned order also says that in the school records her age is 14 years.

Patna High Court Cr.Misc. No.9619 of 2018(2) dt.19-02-2018 2/2 Having considered the said facts and circumstances, prayer of bail of the petitioner is rejected in connection with Araria P.S. Case No.769 of 2017, pending in the court of learned CJM, Araria.

However, the trial court is directed to expedite the trial and preferably conclude the same within a year.
