JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Andar P.S. Case No. 124 of 2019 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 325, 379, 384, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

As per FIR petitioner has fired on the informant but that did not hit anyone and thereafter co-accused Sonu Dubey assaulted him by butt portion of gun, causing fracture injury to him and thereafter all accused persons assaulted him by rifle and gun, causing head injury to the informant and further petitioner is accused in two other cases also.

Submission of learned counsel for the petitioner is that there is land dispute between the parties and informant got a sale deed registered from the uncle of the petitioner with respect

Patna High Court CR. MISC. No.69410 of 2019(2) dt.05-11-2019 2/2 to land of the petitioner and when he made inquiry for that he has assaulted by accused persons and for that case has been lodged by the petitioner's side and petitioner has also received injuries.

Heard learned APP and learned counsel for the informant, who has opposed the prayer for anticipatory bail stating that petitioner has criminal antecedents and injury on the informant is grievous in nature though injury is on his arm. In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IX, Siwan, in connection with Andar P.S. Case No. 124 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
