The petitioner apprehends her arrest in a case registered for the offence under Section 406 of the Indian Penal Code and Section 7 of the E.C.Act.

Allegation against this petitioner, who is licensee dealer of PDS shop, is that on the date of inspection, huge discrepancy was found in the quantity of food-grains in the Poss machine and stock register.

It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case and there is no allegation of any black-marketing against this petitioner. Discrepancy was found on the same date when Poss machine was not functioning properly, for which, several complaints were made but it was not repaired and therefore, the alleged discrepancy occurred in the stock. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.74564 of 2022(2) dt.24-03-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - V, Darbhanga in connection with Manigachhi (Wajitpur O.P.) P.S. Case No. 181 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
