The petitioners, already in custody, seeks bail in connection with Special Case No. 3207 of 2017, corresponding to Narpatganj ( Ghurna) P. S. Case No. 545 of 2017, registered under Sections 272 , 273 of the Indian Penal Code and 30 (a) of the Bihar Prohibition and Excise Act, 2016.
The allegation in brief is that the petitioners and others were carrying 96 bottles each of 180 ml. and 06 bottles of illicit Nepal made wine on motorcycle and after seeing the police, the petitioners escaped away, leaving the motorcycle. Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.4053 of 2018 (2) dt.25-01-2018 2/2 petitioners are named in the F.I.R. and motorcycle does not belong to the petitioners and have no any criminal antecedents and they are in custody since 07.12.2017.
Having considered the said facts and circumstances, let the petitioners, Bulla and Sakim Alam @ Sakeem, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand)each with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions-cum- Special Judge, Araria in connection with Narpatganj ( Ghurna ) P.S. Case No. 545 of 2017.
