The petitioner is seeking regular bail in Special Case No. 163 of 2017 (NDPS) arising out of S.K. Puri P.S. Case No. 290/17 registered for the offence under Sections 20/22 of N.D.P.S. Act.

Learned counsel for the petitioner submits that there is no recovery from conscious possession of this petitioner as it is alleged that 100 gm. open Ganja was kept in polythene and 5 gm was trapped in two small Chimki which were recovered from a Gumti and not from this petitioner. Learned counsel further submits that the petitioner has got no criminal antecedent and the co-accused has been granted regular bail by a co-ordinate bench of

Patna High Court Cr.Misc. No.4819 of 2018 (2) dt.02-02-2018 2/2 this Court in Cr. Misc. No. 62361/2017.

Learned counsel for the State is present.

Considering the facts and circumstances, let the petitioner, named above, be enlarged on bail on his furnishing bail bonds of Rs. 15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge-cum-Special judge, Patna in Special Case No. 163/2017 (NDPS) arising out of S.K. Puri P.S. Case No. 290/2017, subject to the conditions as laid down under Section 437(3) Cr.P.C.
