2. This is the second attempt of the petitioner for grant of regular bail in connection with Harsidhi P.S. Case No. 395 of 2023 registered for the offence under Sections 304B, 302/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is the husband of the deceased and he along with others is said to have been involved in the killing of the deceased. The petitioner is in custody since 24.07.2023.

4. It has been submitted by the learned counsel for the petitioner that though, the petitioner is the husband of the deceased but in the trial no witness has been examined till date.

5. Considering the facts of the case, the period of custody and the delay in trial, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-4, Motihari, East Champaran/concerned Court below in connection with Harsidhi P.S.
