JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 This is an application for grant of anticipatory bail in connection with Gwalpara P. S. Case No. 92 of 2018 disclosing offences under Sections 406, 409, 420 and 120B of IPC. As per prosecution case there is allegation of defalcation and misappropriation of crores of rupees by one coaccused Shambhu Kumar Rajak, the postal peon and it appears that he opened several accounts in the name of the petitioner and several other persons and transferred the amount in those accounts and later on, withdrawn the same.

Submission of the learned counsel for the petitioner is that the F.I.R. itself shows that the amount was deposited in his account and withdrawn by the other co-accused person. Considering the same, one of the co-accused has been granted privilege of anticipatory bail, vide order dated 31.07.2019

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Sub-Divisional Judicial Magistrate, Uda-Kishunganj, Madhepura, in connection with Gwalpara P. S. Case No. 92 of 2018 with condition to co-perate in the investigation and appear before the police as and when required.
