The petitioner is accused in connection with Bikramganj P.S. Case No. 239 of 2017, registered under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that on receiving secret information regarding carrying of illicit liquor by car No. DL-80C-1192, the Police reached there, on seeing the Police party, all the persons succeeded to flee away. On search of the aforesaid car, 960 pouches of 200 ML, country made liquor recovered. At that time, informant and other Police officials identified five persons, including the petitioner, in the light of torch.

Patna High Court Cr.Misc. No.16983 of 2018(2) dt.29-03-2018 2/2 Learned counsel for the petitioner submits that the petitioner was not apprehended on the spot nor he is owner of the vehicle. Further submission is that, in fact, petitioner is accused in Dawath P.S. Case No. 5 of 2012 and due to that reason, he has falsely been implicated in this case. The petitioner is in custody since 24.12.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-II-cum-Special Judge (Excise), Rohtas at Sasaram in connection with Bikramganj P.S. Case No. 239 of 2017.
