JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 09-10-2023 On perusal of the report dated 03.03.2022 of the SubInspector of Police, Sadar Police Station, Hajipur addressed to the Chief Judicial Magistrate, Vaishali, Hajipur, it appears that the police has conducted a preliminary inquiry into the matter

Patna High Court CR. WJC No.102 of 2023(2) dt.09-10-2023 2/2 and after hearing both the parties, concluded that because the shop owner is not willing to provide the shop on rent to the petitioner, therefore, he is indulging in filing these kind of complaints here and there.

2. In the nature of the report available on the record, this Court finds no reason to issue any direction to respondent no. 6 to register a case. This Court would, thus, not exercise its extraordinary writ jurisdiction for the kind of reliefs prayed in this case.

3. This writ application is being disposed of with liberty to the petitioner to seek his remedy before appropriate court/forum in accordance with law.
