2. The petitioner is named in the F.I.R. and apprehending his arrest in connection with Amarpur P.S. Case No. 611 of 2024 registered for the offences punishable under Section 135 of the Bihar Electricity Act.

3. As per FIR, petitioner alleged to commit theft electricity for which outstanding bill of Rs. 4,12,765/- was raised against the petitioner, which is still due.

It is submitted by learned counsel appearing on behalf of the petitioner that property in issue which alleged to belongs to this petitioner infact a joint family property occupied by different family members and, therefore, raising bill individually against petitioner is not justified. It is submitted that due to

Patna High Court CR. MISC. No.79427 of 2025(4) dt.24-02-2026 2/2 sharing of liabilities the bill is unpaid till date. It is submitted that the allegation qua using commercial activities of illegal connection is completely false on its face.

5. Learned APP opposes the prayer of bail.

6. In view of aforesaid factual submission and by taking note of fact as alleged illegal connection prima-facie not appears to be found in shared property of petitioner, who is a man of clean antecedent, accordingly petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Banka/concerned Court, where the case is pending in connection with Amarpur P.S. Case No. 611 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C/ Section 482(2) of BNSS.
