Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Dhanarua PS case no. 20 of 2024, disclosing offences punishable under Sections 307, 354 of the Indian Penal Code.

The prosecution story, as per the First Information report, is that on 10.01.2024, due to quarrel between the children, the petitioner assaulted the informant by iron rod on her head and when her husband intervened, he was also assaulted by the petitioner with iron rod on his legs. 4.

Learned Counsel for the petitioner submits that both parties are agnates and reside at the same place. He further submits that the occurrence took place due to quarrel between

He next submits that injury caused to the informant is simple in nature, as would be evident from injury report, annexed as Annexure-P/2. He also submits that no injury has been sustained by the husband of the informant. 5.

Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation and the fact that the injury caused to the informant is simple in nature and both parties are agnates, I am inclined to grant the privilege of anticipatory bail to the petitioner. 6.

This application is, accordingly, allowed.

Let petitioner, abovenamed, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st class, Masaurhi, Patna in connection with Dhanarua PS case no. 20 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
