2. The petitioner seeks bail in a case registered for offence under Sections 302/34 of the Indian Penal Code.
3. The informant alleges that on 17.10.2024 at about 12.00 PM. his 18 years old daughter (deceased) went missing after leaving for stitching classes. Later on, she was found dead at the house of co-accused Chandan Kumar.
4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case only on suspicion. There is no eye-witness to the alleged occurrence. In fact, there was love affairs between the deceased

No.81076 of 2024(3) dt.04-04-2025 2/3 and co-accused Chandan Kumar and petitioner has been made accused merely because he happens to be elder brother of coaccused Chandan Kumar. As per F.I.R. itself, it was this petitioner, who called the informant and facilitated the talks between the deceased and informant on his mobile phone and as such, he cannot be said to be involved in the murder of informant's daughter. As a matter of fact, the deceased went to the house of co-accused Chandan Kumar where she was not accepted and due to this reason, some quarrel took place between the two and ultimately, she committed suicide. The dead-body of deceased was recovered in the house of coaccused Chandan Kumar, who has already been granted bail by the Juvenile Justice Board, Banka. Petitioner has got clean antecedent and is in custody since 25.06.2024. Chargesheet has been submitted.
5. Learned A.P.P. for the State vehemently opposed the bail petition.

Considering the aforesaid facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Belhar P.S.
