2. The petitioner seeks regular bail in connection with Sessions Trial No. 591 of 2024 arising out of Silao P.S. Case No. 181 of 2021, lodged on 20.11.2021, under Sections 302/120(B) of the Indian Penal Code and Section 27 of the Arms Act.
3. Learned Counsel for the petitioner submits that the bail application of the petitioner was earlier rejected vide order dated 15.05.2024, passed in Cr. Misc. No. 29711 of 2024, with liberty to renew his prayer for bail after the framing of charge. Counsel further submits that the charge in this case was framed on 03.09.2024. Counsel further submits that a report regarding

Counsel further submits that he has attached a copy of the deposition in the form of a supplementary affidavit, which reveals that there is no eyewitnesses to the occurrence. Furthermore, Counsel submits that the petitioner has six criminal antecedents and has been in custody since 03.08.2023.
4. Learned Counsel for the State opposes the prayer for bail and submits that a report has been called for regarding the present stage of the trial. From the report, it transpires that out of nine witnesses, only one witness has been examined, and the case has been fixed for prosecution evidence.

In this background, let the Superintendent of Police, Nalanda, is hereby directed to ensure the production of prosecution witnesses in connection with Sessions Trial No. 591 of 2024 arising out of Silao P.S. Case No. 181 of 2021 for examination to facilitate a speedy trial. He is also directed to take all necessary steps, through the concerned S.H.O./I.O. to ensure that the evidence of all prosecution witnesses is completed within four months from the date of production of this order.
6. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to
Patna High Court CR. MISC. No.78255 of 2024(3) dt.05-02-2025 3/3 grant bail to the petitioner. Therefore, the bail application of the petitioner is hereby rejected.
7. The Registry is directed to transmit a copy of this order to the Superintendent of Police, Nalanda through fax, email or any other mode forthwith and Learned Additional Public Prosecutor is also directed to communicate this order at his level in this regard.
