2. The petitioner is in custody in connection with Bhagwan Bazar P.S Case No. 440 of 2025 registered for the offences punishable under Sections 303 (2), 112 (2), 317 (4), 3 (5) of the BNS.

3. As per prosecution case, it is alleged that petitioner along with co-accused have stolen the motorcycle of the informant.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is

Patna High Court CR. MISC. No.74696 of 2025(3) dt.21-01-2026 2/3 further submitted that petitioner has got no criminal antecedent as stated in paragraph no. 3 of the bail petition. It is also submitted that petitioner is in judicial custody since 02.08.2025.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR, case diary and impugned order, it appears that in case dairy name of the petitioner along with co-accused have been mentioned where petitioner has been identified in CCTV while stealing the motorcycle of the informant. Petitioner is under custody since 02.08.2025. Petitioner has got no criminal antecedent.

7. Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM 2nd, Saran at Chapra / concerned court in connection with Bhagwan Bazar P.S Case No. 440 of 2025, subject to the condition that petitioner shall present physically before trial Court on each
