JUSTICE BIRENDRA KUMAR ORAL ORDER 28-03-2018 The appellant was allowed bail by this Court in Cr. Appeal (SJ) No. 190 of 2018 in connection with Sono P.S. Case No. 50 of 2017 on 12.02.2018.

When this appeal was listed for admission, it was noticed that this appeal was filed on 02.02.2018 itself and this fact was suppressed in Cr. Appeal (SJ) No. 190 of 2018. The same person is deponent in both the criminal appeals. Thereafter show cause notice was issued to the appellant as well as the deponent. The report of the learned court below would reveal that appellant has not been released in pursuance of order aforesaid.

The appellant or the deponent has not filed their show cause in spite of service of show cause notice. The deponent is maternal uncle of the appellant. Hence, order passed in Cr.

Patna High Court CR. APP (SJ) No.415 of 2018 (3) dt.28-03-2018 2/2 Appeal (SJ) No. 190 of 2018 dated 12.02.2018 stands recalled. Let a criminal complaint be initiated against the appellant as well as the deponent of the case for suppression of fact with intent to mislead the course of justice. With the aforesaid observation, this appeal stands disposed of.
