JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-05-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 307/379/380 427 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, all the FIR named accused persons including the petitioners assaulted the informant and his wife.

Learned counsel appearing for the petitioner submits that there is general and omnibus allegation of assault against all the accused persons and no specific overt act has been alleged against the petitioner. Specific accusation of assault is against co-accused Arvind who has already been allowed anticipatory bail by a co-ordinate bench of this Court vide order passed in

Patna High Court CR. MISC. No.4571 of 2023(2) dt.09-05-2023 2/2 Cr.Mis.No. 73787/2022. Petitioner claims clean antecedent. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Udakishunganj, Madhepura in Chousa Police Station Case No. 96 of 2017, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
