2. The petitioner has preferred this application for grant of regular bail in connection with Bhagwan Bazar P.S. Case No. 484 of 2024 dated 16.09.2024 registered for the offences punishable u/ss 109, 308(2), 308(5) read with Section 3(5) of the B.N.S. and Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner along with the other co-accused persons fired on the informant. It is further alleged that on 10.09.2024, Rs. 2 lacs was demanded as extortion money from the informant through mobile No. 9608654619 by the petitioner on whatsapp no. 9241156046.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.73857 of 2025(4) dt.16-10-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case. There is case and counter case between the parties. The petitioner has never attacked on the informant. It is further submitted that no extortion was demanded from the informant by the petitioner. There is no eye witness to the alleged occurrence. No incriminating article has been recovered from the conscious possession of the petitioner. The petitioner has five criminal antecedents in which he is on bail in four cases as stated in para 3 of the bail petition. The petitioner is in custody since 01.09.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that the anticipatory bail application of the petitioner was earlier rejected by the Coordinate Bench of this court vide order dated 05.02.2025 passed in Cr. Misc. No. 90141/2024.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Saran at Chapra in connection with Bhagwan Bazar P.S. Case No. 484 of 2024 with the condition :- (i) The petitioner is directed to remain physically present

Patna High Court CR. MISC. No.73857 of 2025(4) dt.16-10-2025 3/3 before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
