JUSTICE ARUN KUMAR ORAL ORDER 30-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Govindpur PS Case No. 131 of 2017 registered under Section 30A of the Bihar Prohibition and Excise Act.

The allegation in brief is that 300 litres of mahua liquor and some utensils were recovered from near a hill and the petitioner and others were apprehended on the spot.

Learned Counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner, several persons nearby the place were apprehended including the petitioner, he is in custody since 20.11.2017 and has no criminal antecedent. Having considered the said facts and circumstances, the petitioner, namely, Ranjeet Rajvanshi is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II -cum- Special Judge (Excise) Nawada in connection with Govindpur PS Case No. 131 of 2017.
