JUSTICE BIRENDRA KUMAR ORAL ORDER 13-03-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are in custody in connection with Govindganj P.S. Case No.195 of 2017, a case under Sections 341/323/504/448/427/34 of the Indian Penal Code. There is general and omnibus allegation against seven FIR named accused of commission of abuse and assault including the petitioners for commission of assault. There is counter case also. Subsequently, wife of the informant who was assaulted died. Hence, offence under Section 302 of the Indian Penal Code was also added.
Submission is that the occurrence took place for land
Patna High Court Cr.Misc. No.14469 of 2018 (2) dt.13-03-2018 P2/ dispute. The nature of the occurrence does not disclose the commission of intentional death.
Considering the aforesaid fact, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Govindganj Police Station Case No. 195 of 2017, with condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
