Petitioner seeks bail in a case registered for the offences punishable under Sections 420, 409/34 of the Indian Penal Code.
Allegation against the petitioner is of defalcation of public money meant for construction of the school building. The petitioner is in custody since 04.08.2016.
In the past, prayer for bail was refused by this Court in Cr.Misc.No. 48543 of 2016 with direction to the learned Trial Judge to conclude the trial within nine months from the date of receipt /production of a copy of the order dated 30.01.2017.
Patna High Court Cr.Misc. No.2623 of 2018 (4) dt.21-03-2018 The report of the learned Trial Judge dated 31.01.2018 would reveal that the trial has not concluded as yet.
Considering the period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sirdalla Police Station Case No.36 of 2016, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
