JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-11-2019 This is an application for grant of anticipatory bail in connection with Bettiah Mufassil (Banuchhapar) P. S. Case No. 109 of 2018, disclosing offences under Sections 147, 148, 149, 188, 308, 447, 504, 506, 353 and 332 of the Indian Penal Code. As per F.I.R. when the informant Circle Officer went over the land for delivering of possession to one Rajendra Shukla, a mob of about 100 people has assembled there causing obstruction for discharging of the public duties, damaged the JCB Machine and other materials there.

Submission of the learned counsel for the petitioner is that no specific allegation has been attributed against him. He has no concerned with the land, for which, delivery was made. He has no criminal antecedent.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M. Bettiah, West Champaran, in connection with Bettiah Mufassil (Banuchhapar) P. S. Case No. 109 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
