JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-03-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 13.11.2017 passed in Cr.Misc.No.50786 of 2017 with direction to learned trial court to verify the allegation against the petitioner and pass order on the prayer of the petitioner after framing of charge in this case. It appears that petitioner has moved the trial court and prayer for bail has again been rejected.
Submission of learned counsel for the petitioner is that though it is alleged in the FIR that petitioner shot fire from his pistol and in paragraph-11 of the case diary there is allegation of firing against the petitioner and two other accused persons but paragraphs 32, 34, 36 and 60 of the case diary show that there is allegation of firing against Ranvijay Kumar and one more accused
Patna High Court Cr.Misc. No.12935 of 2018 (3) dt.21-03-2018 2/2 person by rifle and he is in custody for more than one year. Heard learned APP also, who has opposed the prayer for bail stating that in FIR name of petitioner has been mentioned and firing was made by him.
Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioner. However, learned trial court is directed to expedite the trial as charge in this case has been framed. With the above observation, this application is dismissed. (Vinod Kumar Sinha, J) spal/- U
