JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-01-2021 No one appears on behalf of the petitioner on repeated call. Learned counsel of the informant as well as learned Additional Public Prosecutor for the State are present. The record goes to show that since last several dates, no one is appearing/ joining the proceeding on behalf of the petitioner.

It would appear from perusal of order dated 05.03.2020 that this Court directed the petitioner to file specific affidavit in respect of compliance of the terms and conditions fixed by the Mediation Centre, Patna High Court, Patna on 16.01.2020. In spite of specific direction of this Court petitioner did not file any specific affidavit in respect of compliance of terms and conditions fixed by the Mediation Centre, Patna High Court, Patna .

Patna High Court CR. MISC. No.70645 of 2019(9) dt.11-01-2021 2/2 Learned counsel appearing for the informant submits that earlier the dispute of the parties was referred to Mediation Centre, Patna High Court, Patna where petitioner and informant entered into an agreement and the aforesaid agreement was produced in writing but the petitioner did not comply with the terms and condition of agreement.

In view of the aforesaid facts as well as submission,s this petition stands dismissed for default.
