Petitioner seeks bail in a case registered for the offences punishable under Sections 3⁄4 of the Explosive Substance Act, Section 17 of the Criminal Law Amendment Act and Section 10/13 of the Unlawful Activity (Prevention) Act, 1967. The petitioner is in custody since 18.07.2013. Considering the general and omnibus allegation a Coordinate Bench of this Court has granted bail to co-accused Ram Babu Paswan @ Dhiraj, who was in custody for last one year, in Cr. Misc. No. 42299 of 2015.
Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the
Patna High Court Cr.Misc. No.5158 of 2018 (2) dt.30-01-2018 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 88 of 2015 arising out of Runni Saidpur Police Station Case No. 290 of 2012, subject to the condition that both the bailors shall be local residents of the territorial jurisdiction of the court below having immovable property in his name and the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
