JUSTICE ARUN KUMAR ORAL ORDER 12-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Teragacch PS Case No. 46 of 2017 registered under Sections 341, 323, 447, 504, 302, 34 of the IPC.

The allegation in brief is that due to land dispute all accused persons turned up and started assaulting the informant; when his wife came for rescue then she too was indiscriminately assaulted causing her death.

Submission is that there is general allegation against all the accused persons of indiscriminately assaulting to the informant's wife but the post mortem report does not show any external or internal injury rather cause of death assigned is myocardial infraction i.e. cardiac arrest.

Having considered the said facts and circumstances, the petitioner, namely, Md. Nauzer Alam @ Nauzar Alam is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Kishanganj in connection with Terragacch PS Case No. 46 of 2017.
