JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 04-05-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Hajipur (Town) P.S. Case No. 64 of 2022, registered for the offences punishable under Section 392 of the Indian Penal Code.

As per allegation, unknown persons snatched the bag of the informant, containing Rs. 2 lacs.

The learned counsel for the petitioner has submitted that the name of the petitioner has figured in confessional statement of co-accused Manish Kumar, who has been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 73752 of 2022. He has submitted further that on exactly similar

Patna High Court CR. MISC. No.2869 of 2023(3) dt.04-05-2023 2/3 footing, other co-accused Vicky Kumar has also been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 12274 of 2023.

On the other hand, the learned APP for the State has opposed the prayer for bail and submitted that the petitioner has criminal antecedents, as mentioned in paragraph no. 3 of the bail petition, to which the learned counsel for the petitioner has replied that co-accused persons, who have been granted bail by the co-ordinate Benches of this Court, have also contained criminal antecedents.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur (Town) P.S. Case No. 64 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have
