JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-12-2019 This is an application for grant of anticipatory bail in connection with Tajpur (Halai O.P.) P. S. Case No. 160 of 2019, disclosing offences under Sections 147, 148, 149, 323, 341, 307, 506 of IPC and Section 27 of the Arms Act.

As per F.I.R. there is allegation against the petitioner and one co-accused of firing on the informant that does not hit anybody and he escaped from there. It has further been submitted that petitioner is accused in two other cases also. Submission of the learned counsel for the petitioner is that F.I.R. itself shows that nobody received the injury. There is land dispute between the parties and for that, he has falsely been implicated in this case.

Heard learned A.P.P. as well as learned counsel for the informant also, who has opposed the prayer for anticipatory

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, surrender before the court below within a period of three weeks from the date of receipt of certified copy of this order, on surrender, he will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of A.C.J.M.-1st, Samastipur, in connection with Tajpur (Halai O.P.)
