JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 Petitioner seeks regular bail in connection with Majhaulia P. S. Case No. 349 of 2019 registered for the offences punishable under Sections 409/420/34 of IPC. As per F.I.R. the Gun Mattel Bush weighing 1251 Kg was sent by the truck of the petitioner to Gorakhpur, that has not been reached to the destination.

Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case only because he is owner of the vehicle, though the driver has taken the vehicle and now he is in custody for more than five months. Charge sheet has already been submitted. He is ready to abide by any condition imposed upon him.

S. Case No. 349 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
