The petitioner, who is in custody, seeks bail in connection with Sasaram (Model) P.S. Case No. 968 of 2017 registered for the offence punishable under Section 379 and later on added Section 411 of the Indian Penal Code. Informant is the owner of motorcycle, who in his written complaint dated 12.07.2017 has alleged that he had parked his motorcycle on Kachhari 4 lane near temple and he had gone for 15 minutes to finish his work and when he returned he did not found the motorcycle there and thereafter lodged the FIR.
Learned counsel for the petitioner submitted that
Patna High Court Cr.Misc. No.7272 of 2018(3) dt.07-03-2018 2/2 he is innocent and has been falsely implicated in this case. It has further been submitted that the motorcycle has been recovered from one Dharmendra Kumar who in his confessional statement has stated that he has purchased the said motorcycle from the petitioner. Except such confessional statement there is no other incriminating material against the petitioner. It has further been submitted that petitioner has no criminal antecedent and he is in custody since 07.09.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram, in connection with Sasaram (Model) P.S. Case No. 968 of 2017 (S. Kumar, J) veena/- U T
