2. The petitioner apprehends his arrest in a case in connection with Gaurichak P.S. Case No. 552 of 2022, registered for the offences punishable under Sections 457, 380, 506 and 34 of the Indian Penal Code.
3. As per F.I.R., allegation against the petitioner is of commit theft in the house of the informant in his absence as details mentioned in the F.I.R.
4. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Petitioner has got no criminal antecedent mentioned in Para 3 of the bail application. Petitioner has been made accused
Patna High Court CR. MISC. No.86049 of 2023(2) dt.18-01-2024 2/2 on the suspicion. He further submits that one co-accused has been granted bail by a coordinate bench of this Court in Cr. Misc. No. 23618 of 2023 vide order dated 14.07.2023. Nothing incriminating articles has been recovered from the house of the petitioner.
5. Learned APP for the State has opposes the prayer for bail.
6. Having regard to the facts and circumstances of the case and also the similarly situated co-accused has been granted bail by a coordinate Bench of this Court, let the above named petitioner, be released on bail, in the event of his arrest, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending/ successor Court in connection with Gaurichak P.S. Case No. 552 of 2022, subject to the condition as laid down under Section 438
(2) of the Cr.P.C.
