The petitioner seeks bail in connection with Nasriganj P.S. Case No. 211 of 2017 registered under Sections 30(a) and 36 of the Bihar Prohibition and Excise Act, 2016 and Sections 25(1-b)a, 26 and 35 of the Arms Act. The petitioner and co-accused, Dhirendra Prasad and Santosh Kumar Sah were apprehended along with Honda City Car and from the possession of Dhirendra Prasad and Santosh Kumar Sah country made pistol and some liquor were recovered while from the aforesaid car Rs.8,00,000/- was seized.
It is submitted by learned counsel for the petitioner
Patna High Court Cr.Misc. No.22161 of 2018(2) dt.17-04-2018 2/2 that no incriminating article has been recovered from the conscious possession of the petitioner. He has no concern with the aforesaid recovery of arms and liquor or the car, in question. It is submitted that the petitioner was only standing near the car. He has been falsely implicated in the case. He has no criminal antecedent. He has been languishing in custody since 19.10.2017. Similarly situated co-accused, namely, Dhirendra Prasad and Santosh Kumar Sah, have been enlarged on bail by a coordinate Bench of this Court vide order, dated 02.04.2018 and 04.04.2018, passed in Cr. Misc. No. 16344 of 2018 and 17844 of 2018 respectively and charge sheet has been submitted in the case.
Considering the facts, aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Nasriganj P.S. Case No. 211 of 2017 to the satisfaction of the Additional Sessions Judge II-cum-Special Judge, Excise, Rohtas at Sasaram. (Prakash Chandra Jaiswal, J) Shamshad/- U T
