JUSTICE ARUN KUMAR ORAL ORDER 09-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 6.1.2018, seeks bail in By-pass PS Case No. 3 of 2018 registered under Sections 420 and 407/34 of the IPC.
The allegation in brief is that the petitioner was truck driver and the informant's iron steel angle was to be transported to Gorakhpur, the truck disappeared along with the goods. Learned Counsel for the petitioner submits that the petitioner while transporting the goods stopped the vehicle at a tea stall where after taking tea he became unconscious thereafter the loaded truck was taken away by some unknown persons.
Learned Counsel appearing on behalf of the informant submits that no case was instituted ever by the petitioner with regard to taking away the vehicle by some unknown miscreants from him and the case is still under investigation.
Having considered the aforesaid facts and circumstances, the Court is not persuaded to grant bail to the petitioner at present. The application stands rejected.
