The petitioners seek pre-arrest bail in connection with Amarpur P.S. Case No. 276 of 2013 (corresponding to G.R. No. 1643 of 2013) registered under Sections 147, 149, 341, 323, 307 and 504 of the Indian Penal Code.

The accusation is that when the informant, Anil Kumar, reached at his field, saw that some cattle were grazing the paddy crop of his field, then, he removed the cattle from the field, then, Shaligram Yadav asked to kill the informant, on which eleven persons, named in the first information report, including the petitioners, surrounded him and started to cause assault through lathi and stick.

Patna High Court CR. MISC. No.73089 of 2019(2) dt.19-11-2019 2/2 Submission is that while allegation has been made about causing injury to the informant by eleven persons, including the petitioners, but, only one injury was found on the fore-head of the informant, grievous in nature. Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Amarpur P.S. Case No. 276 of 2013 (corresponding to G.R. No. 1643 of 2013) shall be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
