====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 04-11-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Shakurabad P.S. Case No. 70 of 2019 registered for the offences under Sections 304, 337, 338 of the Indian Penal Code. The prosecution case is that the accused persons including the petitioner have fenced their maize field, due to which, two daughters of the informant received electric shock and became senseless and they were taken to Sakurabad hospital, where one was declared dead and another was referred to Jehabad hospital in precarious condition.

Learned counsel for the petitioner has submitted that he has falsely been made accused in this case as at that time, he was not present in the village rather he is doing private job in

Patna High Court CR. MISC. No.67527 of 2019(2) dt.04-11-2019 2/2 Surat and further whole family members have been made accused in this case.

Learned counsel for the petitioner has further submitted that co-accused Shrikant Bind, brother of the petitioner has been granted anticipatory bail by Co-ordinate Bench of this Court on 05.09.2019 passed in Cr. Misc. No.56486 of 2019. Learned counsel for the petitioner further submitted that the charge sheet has been submitted against the petitioner.

In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in connection with Shakurabad P.S. Case No. 70 of 2019.
