The petitioner, who is in custody since 20.07.2019, seeks bail in connection with Amba P. S. Case No. 69 of 2019 dated 19.07.2019 instituted for the offences under Section 414 of the Indian Penal Code.

The petitioner is said to have been arrested with three other accused persons, all of whom were found to have been traveling on a stolen motor-cycle. Learned counsel for the petitioner submits that he has been arrested on mistaken identity. The

Patna High Court CR. MISC. No.70017 of 2019(2) dt.04-12-2019 2/2 petitioner has got no concern with the other accused persons who were arrested at the place of occurrence. The petitioner was only a passerby when the arrests were made. In that process, the petitioner was also mistakenly arrested.

Regard being had to the nature of accusation against the petitioner, grant of bail to the other accused persons by the Coordinate Bench of this Court and the period of his custody, this petition is allowed. The petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Amba P. S. Case No. 69 of 2019.
