The petitioner seeks bail in a case registered under Sections 395, 397 of the Indian Penal Code and Sections 3⁄4 of Explosive Substance Act.

Allegation is that 15-20 unknown miscreants forcibly entered into the house of the informant after breaking the main door and brutally assaulted the inmates of the house including ladies and looted cash, jewellary, boxes. The accused persons pelted bomb over the door to terrorize the co-villagers. It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.08.2019 and has got no criminal antecedent. Charge sheet has been submitted in the

Patna High Court CR. MISC. No.68417 of 2019(2) dt.25-10-2019 2/2 case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on confessional statement of co-accused. There is no recovery of any incriminating article from the petitioner.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka in connection with Banka P.S. case No.531 of 2017.
