JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-05-2023 At the outset, learned counsel for the petitioners seeks permission to withdraw the anticipatory bail application with regard to petitioner No. 4.
Permission is granted.
The anticipatory bail application with regard to petitioner No. 4 namely, Ravi Singh is dismissed as withdrawn. Heard the parties.
Petitioner Nos. 1, 2 and 3 apprehend arrests in a case registered for the offences punishable under Sections 420, 406/34, 120B of the Indian Penal Code.
Patna High Court CR. MISC. No.93 of 2023(2) dt.08-05-2023 2/3 As per prosecution case, four forged sale deeds were executed by the F.I.R. named accused persons including these petitioners by hatching conspiracy in the name of making death certificate.
Learned counsel appearing for the petitioners submits that petitioner Nos. 1 and 3 are bona fide purchasers and after payment of due consideration the aforesaid sale deeds were executed. Petitioner No. 2 is husband of petitioner No. 1. He next submits that informant executed the sale deed in favour of the petitioner out of her own will and this fact is further verified by the certificate under the signature of Sub-Divisional Magistrate (Annexure-2). Petitioners have got clean antecedent. However, learned counsel for the informant opposes the bail application of the petitioners.
Considering the aforesaid facts and circumstances, let the above named petitioner Nos. 1, 2 and 3 in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Madanpur P. S. Case No. 513 of 2022, subject to condition as laid down under Section 438(2) of
Patna High Court CR. MISC. No.93 of 2023(2) dt.08-05-2023 3/3 the Code of Criminal Procedure.
