JUSTICE ARUN KUMAR ORAL ORDER 12-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 17.2.2018, seeks bail in Parbatta PS Case No. 147 of 2015 registered under Sections 302, 120B of the IPC and Section 27 of the Arms Act. The allegation in brief is that the deceased was intercepted by the accused persons on the way and Rajesh Choudhary shot at him twice followed by shot by Ram Pukar Singh. Learned Counsel for the petitioner seeks bail of the petitioner on the ground of parity as one of the accused Prakash Choudhary has been granted bal by a coordinate Bench of this Court in Cr. Misc. No.
49917 of 2016 and further submits that that there is no allegation against the petitioner of shooting at the deceased rather is same is against two accused persons Rajesh Choudhary and Ram Pukar Singh and the motive of killing was against Prakash Choudharty and not against the petitioner.
Having considered the said facts and circumstances, the petitioner, namely, Bedanand Chaudhary is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM lst, Khagaria in connection with Parbatta PS Case No. 147 of 2015.
