The petitioner seeks bail in Barauli P.S. case No. 185/2019 registered under Section 302, 201, 34 of the Indian Penal Code.
The informant alleged that petitioner was always torturing his sister and she was done to death by the petitioner. The learned counsel for the petitioner submits that petitioner is, of course, husband of the deceased but the petitioner got two children from the wedlock and there is no material to show that petitioner killed his wife but it appears from the case diary that the petitioner used to take wine and he after taking wine subjected his wife to all sorts of torture. Some of the witnesses disclosed that after frustration with her life and mis-behaviour of the petitioner the deceased committed suicide
Patna High Court CR. MISC. No.71399 of 2019(3) dt.06-03-2020 2/2 but the petitioner hurriedly cremated her dead body. Considering the facts aforesaid and the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. The trial court is directed to expedite the trial, hold the trial on day to day basis and conclude the same within nine months from the date of receipt of this order. If the trial is not concluded within nine months the petitioner, if so advised, may renew his prayer for bail. (Prabhat Kumar Jha, J) BKS/- U T
