Petitioner, already in custody, seeks bail in connection with Jurawanpur P.S. Case No.34 of 2017, registered under Sections 147, 148, 149, 341, 323, 324, 307, 302, 504, 506 and 452 of the Indian Penal Code as well as under Section 27 of the Arms Act. Allegation in brief is that due to land dispute, it is alleged that Vijay Rai shot at the informant's father on his right side of the chest, Munki Rai shot at the abdomen of the Mithilesh Rai, both died, and in the meanwhile, Subosh Rai, Uma Shankar Rai and Ajay Rai started firing with the country made pistol causing firearm injury in the left hand of Anil Rai.
Learned counsel for the petitioner submits that there is land dispute between both sides, the specific allegation of killing is
Patna High Court Cr.Misc. No.8923 of 2018(2) dt.15-02-2018 2/2 against Vijay Rai and Munki Rai and the allegation against the petitioner is that he and two others shot at Anil Rai but only one injury is found on the hand of Anil Rai and charge-sheet has been submitted in this case.
Having considered the fact that there appears only allegation against this petitioner and two others is of shooting at Anil Rai but only one injury is found on the hand, so petitioner Ajay Rai is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-8th, Vaishali at Hajipur in connection with Jurawanpur P.S. Case No.34 of 2017.
