The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 379, 411, 414 and 413 of the Indian Penal Code.

It is a case of recovery of a stolen motorcycle which was recovered from the possession of the petitioner. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case merely on the basis of suspicion. Petitioner has no concern with the alleged recovery, he had come to his matrimonial house and he had taken motorcycle from one of his friends but he is not aware

Patna High Court CR. MISC. No.75044 of 2022(3) dt.19-04-2023 2/2 of the real owner of the motorcycle. Petitioner is languishing in judicial custody since 23.07.2022. It is further submitted that this case is triable by Judicial Magistrate.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Barhara (Raghubansh Nagar O.P.) P.S. Case No. 322 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea.
