2. Petitioners are in custody in a case registered for the offence punishable under Section 309 (6) of the B.N.S.
3. As per the allegation in the FIR, the petitioners
Patna High Court CR. MISC. No.74023 of 2025(2) dt.19-11-2025 2/3 along with other co-accused persons have assaulted the informant, who is a police personnel as their motorcycles were crashed from informant's motorcycle. It is further alleged that both the petitioners have also demanded Rs.5000/- as damage of motorcycle under point of fire arm and when the informant protested them to do so then they snatched his backpack bag containing his police uniform, book, purse, Adhar Card, police ID pran case, Rs.800/- cash and a mobile. The accused persons also taken his Honda sine motorcycle and the informant was carried on a motorcycle near Udashi Devi College where he was beaten by unknown persons.
4. Learned counsel for the petitioner submits that petitioners are innocent and has falsely been implicated in this case. He next submits that no incriminating articles have been recovered from the conscious possession of both the petitioners. He further submits that investigation has already concluded and accordingly charge-sheet has been submitted and no TIP has been conducted by the Investigating Officer during the course of investigation. He next submits that petitioner, namely, Sandeep Kumar is in custody since 21.07.2025 having two criminal antecedents but he is on bail in both the cases and another petitioner, namely, Sardar Patel is in custody since 17.07.2025

5. Learned APP for the State opposes the prayer for Regular bail of the petitioner.
6. Considering the facts and circumstances of the case as well as the submissions made by learned counsel for the both the petitioners, let the above named petitioners be released on bail, on their furnishing bail bonds of Rs.10,000/-(Ten thousand)each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Bhabua P.S. Case No.583 of 2025, subject to the following conditions:- (i) petitioners shall remain physically present on each and every date fixed by the learned Trial Court till conclusion of the trial.
(ii) One of the bailor should be the family member/close relative of the petitioners.
