JUSTICE ARUN KUMAR ORAL ORDER 05-02-2018 Heard learned counsels for the petitioner and the State as well as learned counsel for the informant.
The petitioner, already in custody, seeks bail in connection with Chautarawa P.S.Case No. 180 of 2017 registered under Sections 323, 406 and 420 of the Indian penal Code. Allegation in brief is that there was an agreement between the petitioner and the informant to sell land and Rs. 4,25,000/- was paid in advance by the informant but later on, petitioner retracted and did not execute the sale deed.
Learned counsel for the petitioner submits that there was no agreement for sale in writing and later on, a document of Panchayati was created, however, dispute is pre-dominantly civil in nature and the petitioner is in custody since 21.11.2017 having no criminal antecedent.
Patna High Court Cr.Misc. No.6194 of 2018 (2) dt.05-02-2018 2/2 Learned counsel for the informant opposes prayer for bail. Having considered the aforesaid facts and circumstances, the petitioner, namely, Suresh Yadav is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM, 1st Bagaha, West Champaran in connection with Chautarawa P.S. Case No. 180 of 2017.
