2. The present application has been filed for quashing of the Buddha Colony P.S. Case No. 217/2019 dated 25.06.2019 for the offence under sections 406/420/120B of the Indian Penal Code.

3. As per the prosecution case, informant alleged that for construction of Patna High Court Extension Building, Ambuja Cement was supplied by him and an amount of Rs.

Patna High Court CR. MISC. No.83142 of 2019(3) dt.17-03-2025 2/2 54,17,377/- was became outstanding to the informant. When payment was asked to be made, general reply was given by the petitioners. The informant also sent legal notice to the petitioner which was not replied. Their intention was to be cheat the informant and also embezzle the money for their personal gain. Then the F.I.R. was registered against the petitioners.

4. It has been submitted by learned counsel for the petitioners that the matter has been settled between the parties and a payment of Rs. 47 Lakhs has been made to the informant.

5. Learned counsel for the informant supports submission made on behalf of learned counsel for the petitioners. When the matter has been settled between the parties, there is no need to continue with the proceeding.

6. In the interest of justice, this application is allowed.

7. The F.I.R. of the Buddha Colony P.S. Case No. 217/2019 is hereby quashed against the petitioners. (Sandeep Kumar, J) Ranjeet/- U T
