Petitioners, already in custody, seek bail in connection with Chapra Town P.S. Case No.345 of 2017, registered under Sections 302/34 of the Indian Penal Code.

Allegation in brief is that the informant's husband had gone out of the home and did not return back; the next day he was found killed by the petitioners as suspicion is raised against them due to some previous enmity.

Learned counsel for the petitioners submits that merely on the basis of suspicion, the petitioners' name have been impleaded by the informant, there is no eye-witness to the

Patna High Court Cr.Misc. No.8906 of 2018(2) dt.15-02-2018 2/2 occurrence, suspicion is raised that the deceased was killed by heavy sharp cutting weapon but post-mortem report reveals cause of death due to assault by hard and blunt substance and charge-sheet has been submitted.

Having considered the said facts and circumstances, petitioners Munna Nut, Ganesh Nut, Birendra Nut and Banshi Nut are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Saran at Chapra in connection with Chapra Town P.S.
