JUSTICE SHAILENDRA SINGH ORAL ORDER 17-11-2025 The instant writ petition has been filed by the petitioners under Article 226 of the Constitution of India seeking the following relief(s):- "1. In the nature of "mandamus" directing and commanding the respondent authorities to pave way for the access to the plot belonging to the petitioner no 1,situated at revenue village- Nanand bearing Thana No. 440, Khata No. 545, Khesra No. 2407 admeasuring 10 Decimal purchased for the purpose of business utilization which has been now blocked by proposed construction of 33/11 KV new Electric Power Sub Station at the place just in front of the plot purchased by the wife of the petitioner.

In the nature of "mandamus" directing and commanding the respondent authorities particularly respondent no. 4 to allow construction of electricity power station only after leaving the access to the aforesaid plot of petitioner no. 1 situated at Nanand ,else, for a direction to shift the site of the proposed construction of electricity substation at village-Nanand since the same is blocking the way of the plot of the petitioner no. 1 and same is being constructed on Gairmajarua Malik land ignoring the access of the plots which is falling behind the said proposed construction. III. For any other reliefs for which the petitioners may be found entitled to in the facts and circumstances of the instant case."
2. Mr. Lalan Kumar, learned counsel appearing on behalf of the petitioners and Mr. K.P. Gupta, learned GP-10 for the State-respondents are present and they are heard.

The main grievance raised by the petitioner in this writ petition is that the land purchased by the petitioner no. 1 ( wife of petitioner no.2) for business purposes, situated at Revenue Village Nanand, Thana No. 440, Khata No. 545, Khesra No. 2407, measuring 10 decimals, has been blocked by the proposed construction of a 33/11 KV Electric Power SubStation and the said sub-station is being constructed on Gairmajarua Malik land, disturbing the access to the petitioners'
Patna High Court CWJC No.17682 of 2025(2) dt.17-11-2025 3/3 land and the petitioners, therefore, sent an application dated 27.09.2025 and mailed the same on 29.09.2025 (Annexure- P/5 series) to the District Magistrate- Nalanda (respondent no.2) seeking direction to ensure proper access to the aforesaid plot.
4. Having considered the submissions made by the petitioners' counsel, the District Magistrate, Nalanda (respondent No. 2), is directed to dispose of the petitioners' application dated 27.09.2025 in accordance with law within four weeks from the date of receipt or production of a copy of this order.
5. In the result, the instant writ petition stands disposed of.
