JUSTICE BIRENDRA KUMAR ORAL ORDER 31-01-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Section 30(A) of Bihar Prohibition and Excise Act, 2016.

About 15 liters of Nepali liquor was allegedly recovered from the possession of the petitioner. Petitioner is in custody since 09.12.2017. Petitioner has stated on oath that he has got no criminal antecedent.

Considering the entire facts aforesaid, let the petitioner, above named, on completion of three months of custody, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below

Patna High Court Cr.Misc. No.5180 of 2018 (2) dt.31-01-2018 where the case is pending in connection with C2-691 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
