JUSTICE PRABHAT KUMAR JHA ORAL ORDER 05-03-2020 Heard learned counsel for the petitioners, learned Additional Public Prosecutor and Mr. Durgesh Nandan, the learned counsel appearing on behalf of the informant. The petitioners seek bail in Mohania P.S. Case No.390 of 2019, registered under Sections 323, 341, 342, 504, 506, 406, 420 and 120(B) of the Indian Penal Code.
The informant in sum and substance alleged that his old friend Rahul Kumar Pandey informed him to appear in interview to get appointment in Glaze Trading India Company Limited. Sarfaraj Ansari, Santosh Kumar Singh and Surendra Choudhary took his interview. The petitioner was the Managing Director of the company. The informant handed over
Patna High Court CR. MISC. No.71077 of 2019(3) dt.05-03-2020 2/2 Rs.16,000/- to Sarfaraj Ansari on the assurance that he has passed the interview and would get appointment in the company but later on no appointment letter was given. Learned counsel for the petitioners submits that the case has been compromised. On the basis of such, Santosh Kumar Singh, Sarfraj Ansari, Rahul Pandey and Amit Yadav have been granted bail by a coordinate Bench of this Court vide order dated 06.11.2019, passed in Cr. Misc. No.68658 of 2019. The case of the petitioners stands on the same footing. Mr. Durgesh Nandan who is appearing on behalf of the informant accepted the factum of compromise. Considering the facts aforesaid, petitioners, namely, Ajay Das and Surendra Chaudhary are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur (Bhabua) in connection with Mohania P.S. Case No.390 of 2019.
