02-02-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
Petitioner, in the present case, is seeking regular bail in connection with Paroo P.S. Case No. 63/2017, Trial No. 6093/2017 registered for the offence punishable under Sections 25(1-b)a 26/35 of the Arms Act. Learned counsel for the petitioner submits that as per allegation this petitioner was one of the accused who had fled away with motorcycle in question and had been found injured when they met with an accident. It is also alleged against this petitioner that from his possession one country made pistol and a mis-fired cartridge were recovered. The petitioner has no criminal antecedent and he is in custody since 18.04.2017.
Patna High Court Cr.Misc. No.4944 of 2018 (2) dt.02-02-2018 Learned Additional Public Prosecutor for the State opposes the prayer for bail of the petitioner. Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Paroo P.S. Case No. 63/2017, Trial No. 6093/2017, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure.
